Terms of sale

Article 1 — Object and scope of application

These terms of sale govern sales of merch, decorative objects, clothes, and accessories concluded on the site shop-stranger-things.com between Stranger Things Shop, 29 rue Tronchet, 75008 Paris, France, hereafter “the Seller”, and any non-trading natural person making a purchase, hereafter “the Customer”.

Any order implies unreserved acceptance of these terms. They prevail over any other document. The Seller reserves the right to change them at any time; the applicable terms are those in force on the date of the order.

Article 2 — Products

The products offered are described with their essential characteristics: dimensions, materials, sizes for clothes, power source for light-up objects. The photographs illustrate the items without being contractual as to color shades, which can vary depending on screens.

The items offered are inspired by the world of a television show. They are designed and selected by the Seller, who is linked neither to the broadcaster of that show, nor to its rights holders. The names and titles cited are used for descriptive purposes.

Products are offered subject to available stock. If an item is found to be unavailable after the order, the Customer is informed and refunded as soon as possible.

Article 3 — Prices

Prices are shown in euros, all taxes included, excluding shipping. Shipping fees are specified before the final confirmation of the order. The Seller reserves the right to change its prices at any time; the applicable price is the one displayed at the time of the order.

Article 4 — Orders

The Customer selects the items, checks the details of the cart, enters contact information, then confirms the order. That confirmation, preceded by the express acknowledgment of the payment obligation, forms the contract. A confirmation email summarizing the order is sent to the Customer.

The Seller reserves the right to refuse or cancel any order that presents a legitimate reason, in particular in case of a prior payment dispute or a clearly abnormal order.

Article 5 — Payment

Payment is made online at the time of the order by the methods offered at checkout. Transactions are secured by the payment provider; the Seller has no access to any complete bank data.

Article 6 — Delivery

Shipping is included in the United States and charged 3,90 € to other countries of the European Union. Orders are shipped within two business days after confirmation of payment; the total time, preparation and transit included, is 7 to 12 business days. The Seller undertakes to deliver within the time indicated at checkout and, if none is indicated, within a maximum of thirty days. In case of delay, the Customer may terminate the contract under the terms of article L216-6 of the Consumer Code.

On receipt, the Customer checks the condition of the parcel. In case of damage or a missing item, the Customer makes precise reservations with the carrier and informs the Seller.

Article 7 — Right of withdrawal

In accordance with article L221-18 of the Consumer Code, the Customer has a period of fourteen days from receipt of the order to exercise the right of withdrawal, without having to give a reason for the decision or bear any penalty.

To exercise it, the Customer notifies the decision by an unambiguous statement to contact@strangerthings-shop.fr. The return address is sent in reply. Products are returned no later than fourteen days after that notification, in their original condition, complete, unworn, unwashed, and accompanied by their tags and accessories.

Return shipping is at the Customer's expense. The refund is issued no later than fourteen days after recovery of the goods or proof of their shipment, by the same payment method used for the order. The terms are on the Returns and refunds page, which forms an integral part of these terms.

Article 8 — Legal warranties

Independently of any commercial warranty, the Seller remains bound by the legal warranty of conformity (articles L217-3 and following of the Consumer Code) and by the warranty against hidden defects (articles 1641 and following of the Civil Code).

Under the legal warranty of conformity, the Customer has two years from the delivery of the good. They may choose between repair and replacement, subject to the cost conditions set out in article L217-12. They are excused from proving the existence of the lack of conformity during the twenty-four months following delivery.

Under the warranty against hidden defects, the Customer may act within two years from the discovery of the defect and obtain, at their choice, the cancellation of the sale or a reduction of the price.

Article 9 — Use of the products

The items sold are decorative objects, clothes, and accessories intended for personal use. It is up to the Customer to check the dimensions and, for clothes, the size guide indicated on each product page before ordering. Light-up objects and items with small parts are not toys and must be kept out of reach of young children.

Article 10 — Complaints and mediation

Any complaint may be sent to contact@strangerthings-shop.fr. In accordance with article L612-1 of the Consumer Code, the Customer may use a consumer mediator free of charge with a view to the amicable resolution of a dispute.

The Customer may also use the European online dispute-resolution platform available at ec.europa.eu/consumers/odr.

Article 11 — Personal data

The data collected is needed to fulfill orders. The processing of personal data is described in the privacy policy.

Article 12 — Applicable law

These terms are subject to French law. In case of a dispute, an amicable solution will be sought before any court action.
